Divorce

Facing the emotional challenges of a divorce can be difficult enough without having to address the immediate issues of child care arrangements, property division and support payments. At the Halifax law firm of MDW Law, our family law and divorce lawyers are here to answer your questions and help you make effective choices as we work together to negotiate and settle the terms of your divorce.

Our divorce lawyers offer experienced advice, guidance and representation as you transition to a new phase of your life. We recommend solution-focused options such as collaborative family law or mediation to come to an efficient and effective resolution. For some people, negotiated agreements are not possible. In these cases, we work to protect and assert your legal rights in the courtroom. When you meet with our legal team, we will assess which path to resolution is most appropriate for your unique situation. The extensive litigation experience of our divorce lawyers helps advance your position both in settlement negotiations and at trial.
If you wish to divorce in Nova Scotia, you and your spouse must separate for at least one year. During the separation period, it is often advisable to create a separation agreement that outlines issues such as property division, child support, child custody, shared parenting and spousal support. The separation agreement is a significant step in the divorce process. Once you have agreed to the terms of the separation agreement and the one-year separation period has passed, you can proceed with an uncontested divorce. If you cannot come to an agreement, the court process will be necessary to finalize the divorce settlement.
At MDW Law in Halifax and Bedford, our family law and divorce lawyers see you through all stages of your separation and divorce. We are your trusted advisors through the process of negotiation, litigation and settlement.
